The notion that a user should be cut off when accused of copyright infringement sounds a lot like one of the proposals in the Anti-Counterfeiting Trade Agreement currently being negotiated behind closed doors by major nations and apparently being pushed by Big Content. Scary stuff! Legal systems could potentially become guns for content owners if we let our legislatures get away with this.
